Galvanizing Plant Update

Our council representative Jason Holleman won a major victory against excessive noise in Sylvan Heights. At the council meeting on Sept. 16, an amendment introduced by Councilman Holleman was unanimously approved.

This amendment (Amendment No. 1 to Ordinance No. BL2008-259) reads "No person or persons owning, operating, or having the care, custody, or control of any business or commercial facility shall be permitted to operate any equipment, vehicles, or heavy machinery incident to performing business or commercial functions, or engage in any other business or commercial activity, between the hours of 9:00 p.m. and 6:00 a.m. which would emit, cause to be emitted, or permit the emission of any noise that is plainly audible from the outside wall of any residential structure located within a residential zoning district. The provisions of this paragraph shall not be applicable to business or commercial facilities located within the CC and CF zoning districts. For the purpose of this subsection, ‘plainly audible’ means any sound which clearly can be heard by unimpaired auditory senses.

This ordinance was unanimously approved by the Council on Sept. 16 and signed into law by Mayor Dean on Sept. 19.

This means that if you are bothered by excessive noise from industrial machinery, such as the galvanizing plant, between the hours of 9PM and 6AM, as long as the noise can clearly heard inside your house or apartment, the person or business making the noise is violating the law and you can call the police to make a complaint. Fighting For Cleaner Air

The North American Galvanizing Action Group - Jonathan Gilligan, Judy Hoskins, RC Bartlett, Susan Henderson, Bruce Wood - has been vigilant for the past five years in trying to clean up the air and noise pollution that is given off from the plant located on 32nd Ave. We have brought a couple of cases before the Chancery Court, Metro Health Board and despite our hard work and loads of evidence, in the end the City of Nashville and it's Mayor Bill Purcell are simply unconcerned about the unhealthy levels of pollution and noise we are being forced to live with day in and day out. Our short term goal is to reduce the noise and truck traffic. Long term goal is to force the plant to relocate outside of our residential neighborhood. We need your help!

The Metro Health web site now includes PM2.5 (Fine Particulate Matter, the type of air pollution emitted by the galvanizing plant) in its daily Air Quality Index, a change reflecting the growing awareness of PM2.5's health risks.
